User data is processed by the sole proprietorship Marc TIMMERMANS (“EI MT”), which publishes the website www.myfrenchlawyer.com.

The processing is based on Article 6 of the GDPR, in accordance with the purposes specified in Article 5.

It is important to inform the User of their rights, a list of which is provided in Article 7.

To exercise these rights, Users simply need to send their request to contact@myfrenchlawyer.com and a response will be provided as soon as possible.

We make every effort to ensure the security of User data.

The processing of personal data is governed by:

  • By Law No. 78-17 of January 6, 1978 on information technology, files, and civil liberties (hereinafter “IEL Law”);

The Website does not allow online payment, nor does it offer any payment services via an external provider, as payment is made directly between the User and the referenced lawyer.

Article 4. Lawfulness of processing

Article 5. Purposes of processing

Your various data may be collected by EI MT for explicit, legitimate, and specific purposes in order to ensure:

  • The management of appointment requests,
  • The processing of your legal file
  • The proper functioning and continuous improvement of the WEBSITE, its services and its features;
  • The management of your subscription to the MY FRENCH LAWYER newsletter;
  • The management of requests for access, rectification and opposition, erasure, limitation, portability, the right to digital death and the right to lodge a complaint with the CNIL:
  • Compilation of commercial statistics;
  • Ensuring the security of the MY FRENCH LAWYER website and, in particular, identifying and dealing with any security breaches Complying with our legal and regulatory obligations, responding to any proceedings or requests for information from the authorities or a third party, and preventing and detecting crime and fraud, protecting your rights, our rights or those of third parties;

As a result, you may send third parties the information you view in a section of our WEBSITE. However, certain legal provisions, particularly regarding security issues, may prevent us from doing so.

In accordance with Article 40-1 of the French Data Protection Act, as amended by Law No. 2016-1321 of October 7, 2017, you may define guidelines for the storage, erasure, and communication of your personal data after your death. In the absence of such instructions, your heirs may close your user accounts and object to the continued processing of your personal data or have it updated. Failing this, your personal data will be stored in accordance with this privacy policy.

Article 8: How long we keep your data

EI MT promises that the data we collect will be kept in a way that lets us identify you for no longer than we need to for the reasons we collected and processed it.

However, data processing is possible for the purpose of proving a right or a contract. This data may also be retained for the purpose of complying with a legal obligation or kept in files in accordance with applicable regulations and laws.

For the management of our relationship with you and user tracking, your data is kept for 3 years from the date of your last appointment via the WEBSITE. Beyond this period, the data is archived.

For the management of requests regarding your personal data rights: your data is kept for 1 year.

With regard to cookies, it is specified that information stored on your device (e.g., cookies) or any other element used to identify you for audience statistics purposes is not kept for more than six (6) months. Beyond this period, raw traffic data associated with an identifier is either deleted or anonymized.

Finally, in order to ensure the proper functioning and continuous improvement of the website and its features, raw traffic data associated with an identifier is stored for a period of thirteen (13) months. Beyond this period, it is deleted or anonymized.

This information is kept for the necessary period of time:

  • Users’ personal data is kept for a period of 3 years from the date of the last appointment made by the said user;

Article 9. DPO contact details

EI MT has not appointed a Data Protection Officer (DPO).

Article 10. Security

EI MT and any subcontractors undertake to implement all technical and organizational measures to ensure the security of our processing of personal data and the confidentiality of your data, in accordance with the French Data Protection Act and the European General Data Protection Regulation (GDPR) and Law No. 2018-133 of February 26, 2018 “containing various provisions for adaptation to European Union law in the field of security.”

As such, EI MT takes the necessary precautions, given the nature of your data and the risks presented by our processing, to preserve the security of the data and, in particular, to prevent it from being distorted, damaged, or accessed by unauthorized third parties.

Article 11. Transfer of data outside the European Union

EI MT undertakes not to transfer user data outside the European Union.

In the event that EI MT should do so, it will inform users, indicating the measures taken to control this transfer and ensure the confidentiality of their data.

Article 12. Updating this privacy policy

We may change this policy from time to time.

If we make any substantial changes in the way we use your personal data, we will notify you by means of a notice on the website or by contacting you directly.

If you do not agree to these changes, please do not continue to use the website.
